5.5
Affiliate is aware that as part of the Service, Scoot Media places a cookie to trace the Visitor and the Traffic, and that personal data may be collected in the process of the use of the cookie. Affiliate warrants that prior to placing a cookie and processing personal data, on the Affiliate Site the Visitor:
(i)
will be provided with clear and complete information describing at least the objectives, duration and consequences of the use of the cookie and/or personal data and the role and involvement of Scoot Media, and
(ii)
will be asked to provide (unambiguous) permission for the placement of the cookie and/or processing of personal data. The Affiliate warrants that no cookie will be placed and no personal data collected unless prior permission (in unambiguous form) is obtained in advance, and warrants that it will at all times have documentation available that will allow the Visitor's permission to be demonstrated. The Affiliate will present the documentation to Scoot Media upon demand. The Affiliate will strictly adhere to all instructions of Scoot Media relating to the use of the cookie and the processing of personal data (including instructions relating to the permission and provision of information), and will follow all such instructions in a timely manner.
